P2P in Chile: what the rules say
Chile's Fintech Act, Law 21.521, brought crypto platforms under the Financial Market Commission (CMF). CMF General Rule No. 502 of 12 January 2024 sets out how providers of the services listed in the Act enrol in the Registry of Financial Services Providers and obtain an operating authorisation, and law firm CMS notes that a crypto exchange is caught as an alternative trading system. The transition period closed on 3 February 2025. Since then only parties the CMF has enrolled and authorised, or whose applications filed before that date were approved, may provide those services. The CMF says firms still operating without applying are outside the legal framework and may face inspection and sanctions.
The Central Bank of Chile set out its view in Office Memo No. 219 of 6 February 2019: crypto assets can be used for exchange and investment but are not legal tender, currency or foreign currency.
How people pay: BancoEstado CuentaRUT, Santander, BCI, MACH
- CuentaRUT at BancoEstado accepts no more than CLP 4,000,000 of deposits in a calendar month, with the counter resetting on the 1st, and its balance can never exceed CLP 5,000,000. A deposit only goes through if it respects both limits at once, so a seller whose CuentaRUT is nearly full can bounce your transfer.
- New recipients are the trap for buyers paying from CuentaRUT. The first time you add a seller's account, you can send it a single transfer of up to CLP 200,000 that day, and no more than CLP 600,000 in total to all newly added accounts during the first 24 hours; BancoEstado says these limits can stretch to 72 hours. After that the daily ceiling is CLP 2,000,000. A first order with a new seller may have to be small.
- Other accounts: Santander, BCI, Banco de Chile, Banco Falabella, MACH, Tenpo and Global66 also appear on CLP ads. Check your own bank's limit for new payees before opening an order with someone you have never paid.
Tax and reporting
Crypto follows Chile's general tax rules. According to CMS, an individual's profit from buying and selling crypto assets counts as income subject only to the Global Complementary Tax or the Additional Tax, declared on the amount received, while companies also pay First Category Tax. Crypto exchanges must file Annual Affidavit No. 1891 with the tax service (SII), which covers trades in shares, other securities and digital assets. Keep the transfer receipt for each order to support your cost.
