P2P in Kazakhstan: what the rules say
Kazakhstan runs two crypto regimes side by side. Inside the Astana International Financial Centre (AIFC), the Astana Financial Services Authority (AFSA) licenses digital-asset businesses under the AIFC's own legal system. Its public register lists, for example, Bybit Limited under licence AFSA-A-LA-2024-0027, issued on 25 September 2024 and covering the operation of a digital asset trading facility, custody and money services. Licences there are granted entity by entity, and some on the register are marked suspended or still pending approval to start operations.
Outside the AIFC, amendments to the Law "On Digital Assets in the Republic of Kazakhstan" took effect on 1 May 2026. In its notice of 30 April 2026 the National Bank of Kazakhstan said it now licenses operators that buy and sell cryptocurrency for customers, registers crypto trading platforms and supervises the market outside the AIFC, while the AIFC keeps regulating firms within its own jurisdiction. The law separates unsecured digital assets, meaning cryptocurrencies, from digital financial assets, which include money-backed stablecoins and tokenised real assets. The National Bank granted the first crypto exchange-office licence, to Pax Finance, at the start of July 2026.
How people pay: Kaspi, Halyk, Freedom Bank
Kaspi Bank appears in more KZT ads than any other bank, ahead of Halyk Bank, Freedom Bank, CenterCredit and ForteBank. Transfers between Kaspi Gold cards are free, and money sent from another bank's card to Kaspi Gold costs nothing on Kaspi's side, although the sending bank may charge. Going the other way, from Kaspi Gold to another Kazakh bank's card, carries a percentage fee with a minimum charge, and the money can take anywhere from a few minutes to three working days to arrive; card-network limits per transfer and per month also apply. A buyer who pays a Halyk or Freedom seller from Kaspi Gold therefore pays that fee, and the seller may not see the money straight away.
Lending your account is now a crime. Article 232-1 of the Criminal Code, in force since 16 September 2025, punishes illegally giving, transferring or acquiring access to a bank account or payment card and making illegal transfers for third parties for a fee, with penalties up to seven years in prison. Pay only from an account in your own name and never let a buyer route money through your card.
Tax and reporting
Kazakhstan's State Revenue Committee treats a sale of cryptocurrency as property income: the difference between the selling and purchase price is taxed at 10% individual income tax and reported on declaration form 270.00. Holdings must be declared even without purchase documents, and a wallet record can serve as evidence. A presidential decree of 7 July 2026 sets out a plan to exempt from income tax the gains on crypto operations carried out through regulated Kazakh infrastructure.

Is crypto legal in Kazakhstan?
Yes, under licensing. Inside the Astana International Financial Centre, the AFSA licenses crypto exchanges and other digital-asset firms. Since 1 May 2026, amended rules in the Law On Digital Assets also let the National Bank of Kazakhstan license crypto exchange offices and register trading platforms outside the AIFC, and it issued its first such licence in July 2026. The law separates cryptocurrencies, called unsecured digital assets, from digital financial assets such as money-backed stablecoins and tokenised real assets.
Is Bybit legal in Kazakhstan?
Bybit appears on the AIFC regulator's public register. The AFSA register of digital asset service providers lists Bybit Limited with licence AFSA-A-LA-2024-0027, issued on 25 September 2024 and marked active, covering the operation of a digital asset trading facility, custody, money services and dealing in investments. AFSA licences apply to the named legal entity within the AIFC framework, so check the register for the entity you open an account with, and note that some other crypto firms on the same register are suspended or awaiting approval to start.
How is crypto taxed in Kazakhstan?
The State Revenue Committee treats a sale of cryptocurrency as property income. The gain, meaning the selling price minus the purchase price, is taxed at 10% individual income tax and reported on declaration form 270.00. Holdings must be declared even without purchase documents, and a wallet record can serve as evidence. A presidential decree of 7 July 2026 set out a plan to exempt from income tax the gains on crypto operations made through regulated Kazakh infrastructure, so watch for changes to the tax rules.
