P2P in Mexico: what the rules say

Mexico's Fintech Law defines a virtual asset as a representation of value registered electronically and used by the public as a means of payment, and it excludes the peso and foreign currencies from that definition. Banco de México (Banxico) then fenced the banking system off from it. Its Circular 4/2019, published in the Diario Oficial on 8 March 2019, lets banks and fintech institutions use virtual assets only for internal operations that Banxico has authorised, and it makes any request to offer clients exchange, transfer or custody of virtual assets ineligible for authorisation. That is why the USDT side of a trade sits on an exchange while the pesos travel over ordinary bank rails.

Anti-money-laundering rules tightened in 2025. A reform of the federal law on operations with illicit funds (LFPIORPI), published on 16 July 2025, keeps virtual asset exchange as a "vulnerable activity" and, according to EY's summary, extends it to operations with Mexican citizens carried out from another jurisdiction. Providers must file a notice with the finance ministry (SHCP) once a client's operation reaches 210 times the daily UMA value, and they must hold originator and recipient details for virtual asset transfers.

How people pay: SPEI bank transfer and STP accounts

  • SPEI is Banxico's interbank payment system, and it carries transfers between banks such as BBVA, Banorte and Citibanamex, which together with plain "Bank Transfer" dominate peso ads. You can pay to the seller's 18-digit CLABE, 16-digit debit card number or 10-digit phone number linked to the account. Banxico's rules say a SPEI payment should not take more than 30 seconds after approval.
  • The CEP receipt is your proof. Banxico issues an Electronic Payment Receipt (CEP) for each SPEI payment once the receiving bank confirms the deposit, which can take up to 30 minutes, and anyone can validate the CEP's digital seal on Banxico's site. Send the CEP, not a screenshot, and as a seller ask for one before you release USDT.
  • STP accounts carry a CLABE starting with 646, the code the CLABE catalogue assigns to Sistema de Transferencias y Pagos STP. STP is a SPEI participant that generates individual CLABE accounts for businesses, so a payment to one still runs over SPEI and gets a CEP.

Tax and reporting

The income-tax law has no category written for crypto. In a 2021 preliminary analysis reported by Xataka México, PRODECON, the taxpayer ombudsman, placed crypto sales under the rules for disposals of goods (enajenación de bienes). For a sale above 227,400 pesos it pointed to a 20% provisional payment on the whole amount, withheld by the buyer, who should also issue a CFDI invoice, and it said sales should be declared to the SAT even when the pesos stay on the exchange. Keep each order's CEP and chat log so you can rebuild cost and proceeds at filing time.

Questions people ask

Right now buying 1,000 USDT on P2P costs about 18.690 MXN per USDT (18,690 MXN in total). Selling 1,000 USDT gets about 18.597 per USDT. Updated 27 Oct 2026, 14:58 UTC.

Why is the P2P price different from the official exchange rate?

Is Binance legal in Mexico?

Mexican law handles crypto exchange as a regulated activity. Banxico's Circular 4/2019 stops banks and fintech institutions from offering their own clients crypto exchange, transfer or custody, so Mexicans buy USDT on exchanges and pay in pesos by SPEI. The anti-money-laundering reform published on 16 July 2025 treats virtual asset exchange offered to Mexican citizens from another jurisdiction as a vulnerable activity, with a notice to the SHCP once a client's operation reaches 210 daily UMA values. A platform serving Mexico should therefore identify you and keep your transfer details.

Is crypto legal in Mexico?

Yes, within limits. The Fintech Law defines virtual assets and separates them from the peso and foreign currencies. Banxico's Circular 4/2019, published on 8 March 2019, allows banks and fintech institutions to use them only in internal operations it authorises and not to sell exchange or custody services to clients. Exchange providers fall under the federal anti-money-laundering law as a vulnerable activity, which the July 2025 reform extended to operations with Mexican citizens run from abroad.

Do you pay tax on crypto in Mexico?

Yes, gains are taxable under general income-tax rules, since no crypto-specific category exists. PRODECON, the taxpayer ombudsman, said in a 2021 preliminary analysis that crypto sales fall under the rules for disposals of goods. For a sale above 227,400 pesos it pointed to a 20% provisional payment on the whole amount, withheld by the buyer, and it said sales should be declared to the SAT even if the pesos stay on the exchange. Keep the SPEI receipt and order record for every trade.
