P2P in South Africa: what the rules say
South Africa regulates crypto as a financial product rather than banning it. On 19 October 2022 the Financial Sector Conduct Authority (FSCA) issued General Notice 1350, declaring crypto assets to be financial products under the Financial Advisory and Intermediary Services (FAIS) Act, and licensing of crypto asset service providers (CASPs) began on 1 June 2023. Trading platforms, wallet providers and crypto advisers all need a CASP licence. In an update summarised by DLA Piper on 21 January 2026, the FSCA reported 512 applications, of which 300 were approved, 14 declined and 121 withdrawn after engagement with the regulator, plus 81 investigations into unlicensed activity, 56 still open.
Crypto businesses also sit inside the anti-money-laundering regime: the Financial Intelligence Centre lists crypto asset service providers as item 22 among the categories of accountable institution it supervises.
How people pay: FNB eWallet, bank transfer, cash deposit
- FNB eWallet sends rands to a cellphone number. The recipient dials *120*277#, receives a temporary ATM PIN by SMS and draws the cash at an FNB ATM using that PIN and the cellphone number. FNB caps what a customer can send to an eWallet at R3,000 from Online Banking or the FNB app and R1,500 from Cellphone Banking or an ATM, and one eWallet can hold no more than R5,000. FNB's fraud screening can block a send or cut those limits, and money sent to the wrong number is reversed only at a charge, with no guarantee. Those caps keep eWallet to small orders.
- Bank transfer ads either say so generically or name Nedbank, Absa or Capitec, and a smaller group asks for a cash deposit into a bank account. The chips above show how many sellers accept each option right now.
Tax and reporting
The South African Revenue Service (SARS) applies normal income tax rules to crypto assets. Gains and losses must be declared as part of taxable income in the tax year they are received or accrued, and leaving them out can lead to interest and penalties. Whether a gain counts as revenue under "gross income" or as a capital gain under the Eighth Schedule to the Income Tax Act is decided under existing case law, and expenses incurred in producing the income can be claimed. SARS adds that the Act lets it require third-party service providers to submit financial data. Its crypto page was last updated on 20 March 2026, with FAQs on changes announced in Budget 2026.
What to watch
The FSCA has said it will take enforcement action against any entity carrying on CASP activities without a licence. Check that the platform you use, or its South African entity, holds one.

Questions people ask
What is the USDT to ZAR rate today?

Why is the P2P price different from the official exchange rate?
The official mid rate is 16.599 ZAR per dollar. P2P sellers price in local demand for dollars, payment risk and their margin, so the P2P price is 3.83% above the official rate at the moment.
Which platform is cheapest for USDT in South Africa right now?
Bybit P2P has the best eligible price for a 1,000 USDT order in the latest observation. Platforms change places during the day; the table above is refreshed every 90 seconds for ZAR.
Is crypto legal in South Africa?
Yes. Crypto is legal and regulated. The FSCA declared crypto assets to be financial products under the FAIS Act in October 2022, and since 1 June 2023 businesses that run trading platforms, hold crypto for clients or give crypto advice need a crypto asset service provider licence. By its January 2026 update the FSCA had approved 300 licences and opened 81 investigations into unlicensed activity. Crypto firms are also accountable institutions under the Financial Intelligence Centre Act.
Does Binance P2P work in South Africa?
Rand ads appear on Binance P2P alongside OKX, Bybit and other venues, as the comparison table above shows in real time. South African sellers mostly ask for FNB eWallet, bank transfer or a cash deposit into a bank account. FNB eWallet has tight caps: R3,000 per send from online banking or the app, R1,500 from cellphone banking or an ATM, and a maximum eWallet balance of R5,000, so a larger order has to go by bank transfer instead.
What is the crypto tax rate in South Africa?
There is no separate crypto rate. SARS applies normal income tax rules: a gain is taxed either as revenue under gross income or as a capital gain under the Eighth Schedule to the Income Tax Act, depending on the facts under existing case law, so the rate is whatever applies to your income or capital gains. Gains and losses must be declared in the tax year they arise, and SARS can require service providers to hand over transaction data.
